What is the procedure to transfer property?

  • Completion of Agreement of Sale.
  • Purchaser applies for a loan directly to a bank or through a mortgage originator.
  • M M Fuchs is instructed by the Seller or an Agent.
  • Request bond cancellation figures for the Seller's bond.
  • Request rates / levy clearance figures from the local muncipality / managing agent.
  • When the Purchaser's Mortgage bond finally granted the Title deeds obtained will be send to M M Fuchs
  • M M Fuchs drafts the relevant documentation.
  • Signed by Seller & Purchaser
  • Pro-forma transfer costs obtained from the purchaser.
  • Guarantees obtained.
  • M M Fuchs pays the amount due to local municipality / managing agent to obtain rates clearance certificate.
  • Transfer duty / vat / exemption obtained from SARS.
  • Electrical clearance certificate obtained.
  • Transfer documents are lodged in the Deeds office simultaneously with the bond cancellation and bond documents;
  • Deeds come up for prep.
  • Registration
  • Usually takes 6 – 10 weeks

  • Sales Agreement / Offer to Purchase
  • Identity Document
  • Marriage certificate
  • SARS IT 34 (confirmation of Income Tax reference number)
  • Latest levy/ rates account

Transfer duty is levied according to the following scale:

Natural persons:
· R0 – R500 000 No transfer duty payble
· R500 001 - R1 000 000 The first R500 000 of the purchas price is exempt. Transfer duty is payable at a rate of 5% on the remainder of purchase price
· R1 000 001 > Pay R25 000 and add 8% on the remainder of purchase price

Legal entities ( close corporations, companies and trusts)

  • 8% of the purchase price.
